Hameedullah V. The State ,
MLD 2022 1701 · Balochistan High Court
Hameedullah was convicted by a trial court under Pakistan's Control of Narcotic Substances Act and sentenced to life imprisonment after 300 kilograms of charas (hashish) were allegedly recovered from the car he was driving near Dera Murad Jamali. He appealed to the Balochistan High Court.
The High Court overturned the conviction and acquitted him, citing serious flaws in the prosecution's case. First, there was an unexplained two-hour delay in registering the police report (FIR) after the alleged recovery, which the court said raised doubts about whether the case had been genuinely reported promptly or was later concocted. Second, and more critically, the drug samples were sent to the government forensic laboratory ten days after recovery, far beyond the 72-hour limit required by law. The prosecution offered no explanation for this delay and failed to produce key witnesses, such as the constable who transported the samples or the officer responsible for storing them, to show the samples remained securely handled throughout.
Because the court could not be sure the substance analyzed was the same material taken from the accused, it held that the chain of custody was broken, creating reasonable doubt. Under criminal law, any such doubt must benefit the accused. The court therefore allowed the appeal and acquitted Hameedullah.
This case highlights how strict procedural safeguards, like timely reporting and reliable evidence handling, are essential to secure a valid conviction in narcotics cases.
