MLD 2022 1598 · Balochistan High Court

This case was a criminal acquittal appeal before the Balochistan High Court. The complainant, Dr. Muhammad Arif, alleged that four men broke into his house at night, tried to attack his brother, and when he intervened, fired at him, causing a bullet injury. After the FIR was registered, charges were framed and trial began, with four prosecution witnesses examined. Before the prosecution could complete its evidence, the accused applied under Section 265-K of the Criminal Procedure Code, asking the trial court to acquit them early. The trial court agreed and acquitted them, relying heavily on a medical board report suggesting the complainant's injury was self-inflicted rather than caused by a firearm, even though no evidence had actually been recorded to verify that medical report's authenticity.

The High Court found this acquittal flawed. It held that the trial court acted hastily by accepting a questionable medical report without examining the doctors involved or testing its genuineness through evidence. Since the prosecution had not been given a fair chance to prove its case, the complainant was effectively condemned unheard. The High Court emphasized that courts must decide cases on merits, giving both sides a chance to present evidence, and that justice requires protecting the innocent while also punishing the guilty. The acquittal was partly set aside, and the case was sent back to the trial court for proper proceedings based on full evidence.
