Muhammad Arif and others V. The State through Prosecutor General Balochistan, Quetta ,

MLD 2022 1589 · Balochistan High Court

This case from the Balochistan High Court involved two groups who had filed FIRs against each other arising from the same violent incident on the night of 3 April 2018. One FIR accused Muhammad Arif and others of attacking the complainant and his daughter with sticks, causing injuries. The counter-FIR, filed by Arif, accused the complainant's side of entering his house and firing at his brother. These are known as "cross cases" or counter-versions of the same incident.

The problem was that the two related cases were tried separately by different courts: a Judicial Magistrate convicted Arif and his co-accused for causing hurt, while a Sessions Court, hearing the counter case, acquitted the other side. The High Court found this improper. It held that when cross cases arise from one incident, they must be tried together by the same court, with judgments delivered simultaneously, so the court can determine who was really the aggressor and who was the victim. Trying them separately risks conflicting judgments and unfair convictions based on incomplete evidence.

Because this proper procedure wasn't followed, the High Court set aside both the magistrate's and the appellate court's judgments and sent the case back to the Additional Sessions Judge for a fresh decision, this time handling both cases jointly. The ruling reinforces an important safeguard ensuring fairness in cases involving mutual accusations from the same fight.
