MLD 2022 143 · Balochistan High Court

This case is from the Balochistan High Court and concerns a long-running land dispute in Quetta. The petitioners were recorded as owners of certain land, while the respondents' father had allegedly been wrongly entered in revenue records decades earlier as a "lathband buzgar" (a type of cultivator) over the same property during a 1985 settlement exercise. The respondents filed a revision petition before the Senior Member, Board of Revenue, asking that these old entries be corrected and their names restored as owners. The Senior Member accepted their revision and sent the case back to the Deputy Commissioner for fresh decision.

The petitioners challenged this order, arguing they were never issued notice or given a hearing before the decision was made, and that the Senior Member had no authority to directly entertain a revision over entries that were more than 34 years old, bypassing lower revenue forums. The High Court agreed, noting serious procedural defects: no proper notice, no hearing, and no order from subordinate authorities before the matter reached the Senior Member. It also held that since the dispute involved the title of the property, only a civil court—not revenue authorities acting through mutation proceedings—could decide it. The Court set aside the Senior Member's order and quashed the proceedings.

This case matters because it reinforces that revenue officers cannot decide disputed ownership questions through summary mutation processes, and that due process (proper notice and hearing) must be followed before altering decades-old property records.
