Zahid and other V. Mst Sadia and others,

MLD 2021 798 · Balochistan High Court

This case involved a landlord-tenant dispute under the Balochistan Urban Rent Restriction Ordinance, 1959. Mst. Sadia, the landlady, owned five shops in Quetta that had been rented out for decades to several tenants, including the appellants. She filed an application to evict them, stating she needed the shops for her personal residential use. Her plan was to close the shops and convert them into rooms to be joined with her adjacent house, since her current living situation with her husband's family was cramped and she had no independent accommodation.

The tenants opposed this, arguing the eviction request was made in bad faith to pressure them, that the shops were in a commercial area unsuitable for conversion to residential use, and that losing their long-established businesses would cause them serious harm. They also argued the landlady had not obtained official permission to convert the property's use.

The Rent Controller ruled in favor of the landlady and ordered eviction. The tenants appealed to the Balochistan High Court.

The High Court upheld the eviction order. It held that the law only requires permission to convert a residential property into a commercial one, not the reverse, so the landlady did not need prior approval. It also found her testimony credible and consistent, and that the tenants failed to disprove her genuine need during cross-examination. The court further emphasized that an owner's property rights outweigh a tenant's rights, and tenants cannot dictate whether an owner's need is sufficient. Both appeals were dismissed.
