Rahim Bakhsh V. The State,
MLD 2021 553 · Balochistan High Court
This case involved Rahim Bakhsh, who was arrested at a police checkpoint in Turbat after two kilograms of charas were found in a bag he was carrying, plus another 200 grams from his pocket and 26 grams of crystal (a narcotic substance) recovered from his person. He was charged under section 9(c) of the Control of Narcotic Substances Act, 1997, and applied for bail after the trial court refused it.
His lawyer argued that the case fell into a "borderline" category between lesser and more serious narcotics offences, and that courts should consider the likely actual sentence rather than the maximum possible punishment when deciding bail.
The Balochistan High Court rejected these arguments. It noted that courts have granted bail in genuine borderline cases where the recovered quantity only slightly exceeds the one-kilogram threshold separating offence categories. Here, however, the amount recovered (2000 grams of charas plus 26 grams of crystal) was far beyond any borderline range. The court also relied on a Supreme Court ruling (Socha Gul v. State) holding that in serious narcotics cases, courts should not speculate about likely sentences at the bail stage, as this would interfere with the trial court's sentencing discretion.
The bail application was dismissed. This case matters because it clarifies that bail in narcotics cases is assessed strictly based on the quantity recovered and established legal thresholds, not on guesses about eventual punishment, especially for large-scale recoveries.
