Muhammad Saddiq and another V. Ghulam Sarwar and 3 others,

MLD 2021 2123 · Balochistan High Court

This case involved a long-running dispute over a land sale agreement from 2009. Earlier, the High Court had ruled that the buyer (decree holder) could get the land transferred to his name, but only if he paid the remaining sale price of over Rs. 32 lakh within two months, otherwise the agreement would automatically stand cancelled.

The sellers (judgment debtors) later argued in execution proceedings that since the buyer failed to pay within the two-month deadline, the agreement had lapsed and he could no longer enforce the decree. The case went through multiple rounds, including a Supreme Court order asking the executing court to determine whether payment had actually been offered on time.

The High Court found that the buyer had repeatedly tried to pay through cheques on several occasions, but the payments could not go through either because the sellers were absent or unwilling to accept them, or because court proceedings were stayed. The court also held that delays caused by the court's own scheduling, summer vacations, or litigation should not be held against the buyer, since the court itself had failed to direct him to deposit the money directly into the court's account.

The High Court ruled that the buyer should not suffer because of these external delays and ordered him to deposit the balance sale amount within 15 days, allowing the transaction to proceed. The case highlights that genuine, repeated attempts to comply with a court decree count even if technical deadlines slip due to circumstances beyond a party's control.
