Amanullah V. Additional Sessions Judge Sariab, Quetta and 3 others,
MLD 2021 1742 · Balochistan High Court
This case from the Balochistan High Court involved a man named Amanullah, who had been accused, along with others, of kidnapping and murdering a woman named Mst. Nazia Bibi. An FIR (First Information Report) had already been registered against him based on a complaint by the woman's family.
Amanullah denied the allegations and claimed the opposite had actually happened, that the woman was kidnapped and killed by her own family members in the name of honor, and that he and his family were the real victims. He tried to get a separate, second FIR registered against the woman's family, presenting his version of events. When the local authorities refused, he approached an Additional Sessions Judge acting as a Justice of Peace to order registration of this second FIR, but that request was dismissed. He then challenged that dismissal before the High Court.
The High Court rejected his petition. It held that once an FIR has already been registered for an incident and investigation or trial proceedings have moved forward, a second FIR cannot be registered merely to present a counter-version of the same events by the accused. The court relied on a Supreme Court precedent (Sughran Bibi v. The State) establishing this rule.
This case matters because it reaffirms an important principle of criminal procedure in Pakistan: allowing multiple FIRs for the same incident would create confusion and let every accused person file a competing FIR, undermining the integrity of the investigation and judicial process.
