The State V. Syed Amir Muhammad,

MLD 2021 1381 · Balochistan High Court

This case involved an application by the state, through the Anti-Narcotics Force, to cancel bail that had been granted to Syed Amir Muhammad, who was accused of carrying 4 kilograms of methamphetamine (ice) in a bag. He was arrested in Kuchlak, Balochistan, after officials received a tip that he was selling the drug near schools and language centers.

The trial court had granted him post-arrest bail after seven months in custody, reasoning that prosecution witnesses had failed to appear for several hearings, that no private witnesses such as teachers or students were associated with the case despite allegations of selling drugs near schools, and that a forensic report was doubtful.

The Balochistan High Court disagreed and cancelled the bail. It held that the absence of private witnesses was not a valid ground for bail in narcotics cases, since the law governing such cases specifically excludes the usual requirement of associating independent witnesses with searches. The court also found that the trial court had gone too far by deeply evaluating the evidence at the bail stage, when only a preliminary assessment is appropriate. Additionally, the High Court noted that courts should be cautious about granting bail when a trial is near its final stage.

This judgment reinforces that in serious narcotics cases, bail should not be granted based on technical evidentiary gaps that are meant to be examined at trial, not at the bail stage.
