Sewa Khan V. The State,

MLD 2021 1364 · Balochistan High Court

This case involved Sewa Khan, who was convicted by a Sessions Judge in Kohlu for illegal possession of weapons under the Pakistan Arms Ordinance, 1965. According to the prosecution, Levies personnel tried to arrest him on an outstanding case, and he allegedly opened fire to resist arrest, wounding a constable, before being overpowered and found with an SMG rifle, three magazines, and 35 live cartridges. He was convicted and sentenced to three years' imprisonment plus a fine.

On appeal, the Balochistan High Court overturned the conviction. The court found serious gaps in the prosecution's evidence: the injured constable was never produced in court, nor was any medical certificate presented to prove he was shot; no bullet casings (empties) were recovered from the scene despite claims that firing occurred from both sides; the FIR did not mention whether the accused was asked for a weapons license or confirmed to lack one; and, crucially, the recovered weapon was never sent to a ballistics expert to confirm it was even functional.

The court emphasized that in criminal cases, guilt must be proven firmly through solid evidence, not assumptions. Since the prosecution failed to establish basic facts—like the weapon's working condition or the absence of a valid license—the conviction could not stand. The appeal was allowed, and Sewa Khan was acquitted and ordered released unless wanted in another case. The judgment highlights the importance of forensic verification and complete evidence in arms possession cases.
