Muhammad Naseem V. Vice-Chancellor Bolan University of Health Sciences, Quetta through Registrar and another,
MLD 2021 1333 · Balochistan High Court
This case involved a student, Muhammad Naseem, who had passed the MDCAT entrance test for medical college admission with over 71% marks and expected his name to appear on the district merit list for MBBS admission at Bolan University of Health Sciences, Quetta. When the tentative merit list was published, his name was missing, even though students with lower marks were included. He claimed he had tried repeatedly to contact and visit the university office but was blocked by a staff strike and then by heavy snowfall on the roads. By the time he submitted written objections, the admission process was already complete, so he approached the Balochistan High Court asking it to order the university to include his name on the merit list.
The High Court dismissed his petition. It found that merely passing the MDCAT test was not enough: candidates also had to separately apply online, submit hard copies of their application, pay the required fee, and appear for interview by the university's set deadline. The record showed the petitioner had done none of this, and he only raised his objection weeks after the final deadline had passed. By then, the admission session had already started and other candidates had been lawfully selected. The court held that it could only intervene under Article 199 of the Constitution to correct genuine jurisdictional errors or illegality, and since the university had followed proper procedure, there was no error to correct. A person's own carelessness cannot justify displacing students who were validly admitted.
