Bismillah V. The State,
MLD 2021 1131 · Balochistan High Court
This case involved a man named Bismillah who was charged under section 324 of the Pakistan Penal Code (attempted murder) after an incident where a pistol was used. During his trial, the parties reached a compromise, and the trial court accepted this compromise under section 345(2) of the Criminal Procedure Code, acquitting him of the charge. However, despite acquitting him, the trial court ordered his licensed pistol to be confiscated by the State and directed the cancellation of his arms license.
Bismillah appealed this part of the order, arguing that once he was acquitted, he was entitled to get his property, including the pistol, back, and that the trial court had no legal authority under the West Pakistan Arms Ordinance, 1965 to cancel his license, since that power belongs only to specific licensing or judicial authorities defined in the law.
The Balochistan High Court agreed with him. It held that an acquittal is an acquittal, whether it results from a full trial, an early dismissal of charges, or a compromise between parties, and all such acquittals carry the same legal consequences. Therefore, Bismillah was entitled to the return of his property. The court set aside the confiscation order and directed that the pistol be returned to him, subject to verification of his license by the appropriate authority. This case clarifies that people acquitted through compromise are entitled to the same rights as those acquitted on merits, including recovery of seized property.
