MLD 2021 1001 · Balochistan High Court

This case is about a family property dispute in Quetta. A son and grandson (plaintiffs) sued their relatives, claiming rights to an ancestral house left by their grandfather, which had passed down through the family. During the trial, after evidence was recorded, the plaintiffs asked the court to amend their plaint under Order VI, Rule 17 of the Civil Procedure Code, to add clearer wording about the property being ancestral and to specifically ask for possession of the house, since they were not actually living in it.

The trial court refused to allow this amendment, but when the plaintiffs challenged that refusal before the Additional District Judge, the amendment was allowed. The defendants then approached the Balochistan High Court, asking it to overturn that decision.

The High Court upheld the lower appellate court's order. It explained that amendments to a plaint are allowed unless they introduce a completely new and different cause of action. Here, the proposed changes simply clarified the ancestral nature of the property and added a request for possession, something already implied by the facts already pleaded. This did not change the fundamental nature of the case or bring in a new claim.

The court dismissed the petition, meaning the amendment stands and the case will proceed with the clearer pleadings. The ruling reaffirms a well-established principle: courts should allow amendments that help resolve real disputes, as long as they don't unfairly introduce a brand-new case against the other side.
