MLD 2020 896 · Balochistan High Court
This case involved a dispute over agricultural land in Naseerabad district, Balochistan. The plaintiffs claimed they had never gifted their land to one of the defendants, but their brother had secretly transferred the property into his son's name through a fraudulent gift mutation, without their knowledge. The land was then sold onward to other buyers. The trial court and the appellate body (Majlis-e-Shoora) both ruled in favor of the original owners, cancelling the fraudulent transfer, and the buyers challenged this decision before the Balochistan High Court.
The High Court upheld the lower courts' decisions. It found that the person claiming the gift had the burden of proving when and how the oral gift was made, but failed to do so. There was no evidence showing the actual owners had appeared before revenue officials or signed the mutation documents. Since the transfer was done fraudulently and without the owners' knowledge, the court held that no legal protection could be given to such an act, and importantly, that the normal time limits for filing a lawsuit do not apply when the underlying act itself was illegal.
The court also reaffirmed that when reviewing lower court decisions in this type of petition, it cannot re-examine the facts of the case freely, but only step in if there was a clear legal error or if evidence was ignored or misread. Finding no such error, the court dismissed the petition, meaning the land stayed with its rightful owners.
