The witnesses, who were family members sleeping in the same courtyard, gave inconsistent accounts and admitted they only woke up after the first shot was fired, meaning they could not have seen how the attack began. Despite claims of continuous firing for 10-15 minutes, only 15 shell casings were found. No motorcycle allegedly used by the attackers was ever recovered, and no neighbours were called as witnesses despite the area being inhabited. The medical evidence also contradicted the claim that shotguns were used, since the victims had single bullet wounds rather than pellet injuries. Additionally, the murder weapon was recovered with a suspicious 12-day delay and sent for forensic testing over a month later without explanation, undermining its reliability. Finally, the identification parade used to identify the accused was conducted by a police officer rather than a judicial magistrate, which is not legally permissible, and was unnecessary anyway since the accused were already named in the FIR.
Given these serious doubts and contradictions, the court ruled the prosecution had failed to prove its case beyond reasonable doubt. It set aside the conviction and death sentence, acquitting Anwar. This case highlights how courts scrutinize inconsistent witness testimony, forensic
