Sadiq V. The State through Prosecutor General, Quetta,
MLD 2020 758 · Balochistan High Court
This case involved an appellant named Sadiq who was tried alongside several co-accused for a violent incident in Chaman in 2008, arising from a dispute over an earlier theft. The original complaint alleged qatl-i-amd (murder), attempted murder, and armed rioting, with one person dying after being shot. During the trial, Sadiq remained absconding and was declared a proclaimed offender, while his co-accused stood trial and were ultimately acquitted by the Anti-Terrorism Court.
Despite acquitting the other accused, the trial court separately convicted Sadiq and sentenced him to ten years' imprisonment under Section 21-L of the Anti-Terrorism Act, 1997, a provision that punishes people who abscond to avoid arrest or court proceedings.
The Balochistan High Court found this conviction unlawful. It noted that Sadiq had never actually been charged under Section 21-L, no evidence had been recorded to prove the specific ingredients of that offence, and the trial court had not even framed a proper legal question about it in its judgment. There was also no finding that his absconding was deliberate or that he was genuinely evading justice. Because the conviction was based on a flawed, informal process rather than a proper trial, the High Court set it aside and acquitted Sadiq.
The case matters because it reinforces that even absconding accused persons cannot be convicted through shortcuts—formal charges, evidence, and proper legal reasoning are required before punishing someone under anti-terrorism absconder provisions.
