Alamgir V. The State,
MLD 2020 68 · Balochistan High Court
This case involved a vehicle seized by Pakistan Coast Guards after narcotics, 3.9 kg of charas and 10 kg of opium, were found in its toolbox. The vehicle's registered owner, Alamgir, was not the driver and was not accused in the criminal case. He applied to the trial court for temporary custody of the vehicle (called superdari) while the case proceeded, but the trial court rejected his request.
Alamgir appealed to the Balochistan High Court, arguing he was the undisputed owner, had no connection to drug trafficking, was unaware the vehicle was being misused, and that the vehicle was deteriorating while sitting unused at the police station, harming his family's livelihood. The state opposed this, saying releasing such vehicles would encourage narcotics transportation.
The High Court sided with Alamgir. It noted he was not an accused, the prosecution had presented no evidence showing he knew about the narcotics, and the drugs were found in an ordinary toolbox rather than a hidden compartment built into the vehicle. Relying on a Supreme Court precedent, the court held that a vehicle cannot be confiscated unless it is proven the owner knew it was being used for crime. Since no evidence of such knowledge existed and Alamgir held valid ownership documents, the court set aside the trial court's order and directed the vehicle be released to him on furnishing a surety bond of Rs. 500,000.
This case clarifies that innocent vehicle owners cannot lose their property in narcotics cases without proof of
