Sanaullah V. The State,

MLD 2020 659 · Balochistan High Court

This case involved an appeal against a death sentence for murder. The appellant, Sanaullah, had been convicted by a trial court of qatl-i-amd (murder) under Section 302(b) of the Pakistan Penal Code, based largely on allegations that he kidnapped the deceased for ransom, was last seen with him, and later confessed.

The Balochistan High Court overturned the conviction and acquitted the accused. First, it found that the accused was actually a juvenile (around 17 years old) at the time, as confirmed by a medical board. Under the Juvenile Justice System Act, 2018, juveniles cannot be sentenced to death or ordinary imprisonment with adults, so the trial court's death sentence was unlawful on this ground alone.

Separately, the court found the evidence itself unreliable. The "last seen" testimony was uncorroborated and appeared to be an afterthought, since the witness delayed reporting it for days. The alleged ransom call was never substantiated with phone records, and the people allegedly present when the call was received never reported it either. There was also an unexplained two-day delay in filing the police report (FIR), further undermining the prosecution's case.

This judgment matters because it reinforces two important principles: children must be tried and sentenced under special juvenile protections, not ordinary criminal law, and convictions—especially for capital offences—cannot rest on weak, uncorroborated, or suspicious evidence. The benefit of the doubt must go to the accused when the prosecution's case is unconvincing.
