Rizwan V. The State,
MLD 2020 59 · Balochistan High Court
This case concerns a bail application filed by Rizwan, who was arrested after police on routine patrol allegedly recovered 1300 grams of charas and 300 grams of crystal (a narcotic) from his possession. He was booked under the Control of Narcotic Substances Act, 1997, and his earlier bail request had been rejected by the trial court.
The Balochistan High Court granted him bail. The key reasoning was that the recovered quantity of charas only marginally exceeded 1000 grams, placing the case on the borderline between two different punishment categories under Section 9 of the Act (clauses b and c). Courts have consistently held that in such borderline cases, bail should generally be granted, and where a law provides two possible sentence ranges, the lesser one should be considered for bail purposes. This meant the exact punishment applicable was uncertain and required further inquiry during trial, which is itself a valid ground for bail under Section 497(2) of the Criminal Procedure Code.
The court also noted that since the witnesses were only police personnel and the applicant was already in judicial custody, there was no risk of him tampering with evidence or needing further investigation. Additionally, medical records showed he was suffering from cancer, and keeping him in custody without proper treatment could endanger his life.
The court granted bail on furnishing sureties, clarifying that its observations were tentative and would not affect the final trial outcome. This case illustrates how borderline drug quantities and health concerns can influence bail decisions.
