Rozi Khan and others V. The State and others,

MLD 2020 580 · Balochistan High Court

This case involved an appeal against a murder conviction from the Sessions Court in Pishin, Balochistan. The accused, Rozi Khan and others, had been convicted of murdering the complainant's brother and damaging solar panels at a garden, with Rozi Khan sentenced to life imprisonment.

The Balochistan High Court overturned the conviction and acquitted the accused, finding serious flaws in the prosecution's evidence. The court noted a suspicious four-hour delay in reporting the crime, especially since a Levies checkpoint was located closer than the station where the report was eventually filed. It also found troubling inconsistencies: witnesses left the dead body unattended at the crime scene, then left it overnight at the Levies station before taking it for post-mortem examination the next day - a delay of seventeen hours. The medical report describing the injuries (head wounds and firearm injury) did not match the original account given by witnesses, prompting the complainant to later add a supplementary statement about knife and stick attacks to align with the medical findings. The court also found it implausible that none of the witnesses, who were relatives of the deceased, suffered any injuries despite allegedly being present during a violent attack by an equal number of attackers.

This case illustrates how courts carefully scrutinize witness conduct, timelines, and medical evidence to ensure convictions rest on reliable proof beyond reas
