Bibi Moashara V. Sahib Jan and 10 Others,

MLD 2020 491 · Balochistan High Court

This case concerns a family property dispute in Ziarat, Balochistan. Bibi Moashara, a descendant of one Khalo, filed a lawsuit seeking declaration of ownership, possession, and cancellation of a 1978 mutation (land transfer record), claiming it was fraudulent since no signatures or thumb impressions appeared on it. She argued that certain respondents had wrongly started leveling and excavating ancestral land in 2012 and only then claimed they had purchased it decades earlier through the disputed mutation.

Both the trial court and the appellate court dismissed her suit, and she then filed this civil revision petition before the Balochistan High Court.

The High Court upheld the dismissal, focusing primarily on limitation (time-bar) rules. It held that a declaratory suit must be filed within six years, but the petitioner challenged the mutation more than thirty-four years after it was recorded, without explaining the delay or stating when she first learned of it. Her predecessor-in-interest, who was alive for decades after the mutation, never challenged it either. The court reiterated that a suit barred by time must be dismissed even if no party raises the limitation issue, and that courts cannot assume jurisdiction over time-barred claims. Finding no fraud proven and no error in the lower courts' concurrent findings, the High Court dismissed the revision petition, emphasizing that such findings cannot be overturned without clear illegality or evidence of misreading.
