Muhammad Khan Durrani through Attorney V. Abdul Ali Durrani and 4 others,
MLD 2020 426 · Balochistan High Court
This case is about a property dispute in Quetta, Balochistan. Muhammad Khan Durrani claimed he originally bought a large piece of land, distributed portions of it to his father and brothers, and kept 13 poles for himself, on which he built a house. He alleged that he later asked his relatives to vacate the house for his son's use, but they refused, and his mother claimed the property mutation was actually in her name. He sought a court declaration that he was the rightful owner, that certain mutations (official land records) were fraudulent and should be cancelled, and that he be given possession of the house.
The trial court dismissed his suit, and he appealed. The Balochistan High Court upheld that dismissal. The judges found that the appellant failed to prove his ownership claim with solid evidence — his testimony was contradictory and unconvincing, he provided no witnesses to the original purchase, and he did not adequately rebut the documents produced by the other side, which carried a legal presumption of truthfulness. The court also held the suit was filed too late (barred by limitation) and reiterated the legal principle that anyone alleging fraud must prove it with real evidence, not just verbal claims. The court also noted that a plaintiff must win on the strength of his own case, not merely because the defendants' evidence was weak.
This case illustrates how Pakistani courts require strong, credible proof — not just allegations — in property and fraud disputes, and it reinforces that delays in filing suits can be fatal to a claim.
