Messrs Riegn Nutro Pharma (Pvt.) Ltd. and 2 others V. The State,

MLD 2020 324 · Balochistan High Court

This case involved Riegn Nutro Pharma and its officials, who were accused of selling an unregistered drug, a zinc-based syrup called Maxzin, in violation of Pakistan's Drugs Act, 1976. A Drug Inspector had taken a sample of the syrup, and while lab testing showed it was not substandard, authorities pursued a criminal case against the company because the product had not been registered as a drug. The company argued the syrup was actually a food or nutritional supplement, not a drug, and therefore should be regulated under a different law, the Drug Regulatory Authority of Pakistan Act, 2012, not the Drugs Act.

The trial court had rejected the company's request for acquittal, so the matter came before the Balochistan High Court. The High Court examined the relevant rules defining food supplements, health products, and nutritional supplements, and found that zinc supplements clearly fall into these categories. It noted that after the 2012 DRAP Act and related 2014 rules came into force, authority over such supplements shifted to the Drug Regulatory Authority of Pakistan, not the provincial bodies enforcing the Drugs Act.

As a result, the court ruled that the Provincial Quality Control Board had no legal authority to sanction prosecution against the company for failing to register the syrup as a drug. The court quashed the pending case and acquitted the accused, clarifying that supplements like this must be handled under the newer, specialized regulatory framework rather than general drug laws.
