Kamal Ud Din V. The State,

MLD 2020 2059 · Balochistan High Court

This case involved an appeal against a death sentence handed down by a trial court in Killa Abdullah, Balochistan. The accused, Kamal-ud-Din, along with co-accused, was alleged to have blocked a road and, during a scuffle with the complainant's party, fired a shot that killed the complainant's cousin, while also injuring others using pistols, knives, and daggers. He was convicted under section 302(b) of the Pakistan Penal Code (murder) and sentenced to death, along with a compensation order to the deceased's heirs.

On appeal, the Balochistan High Court examined several defence arguments, including delay in recording witness statements, the fact that eyewitnesses were relatives of the deceased, minor inconsistencies in testimony, and the absence of recovered weapons since the accused was arrested twelve years after the incident. The court held that none of these issues were serious enough to undermine the prosecution's case. It found the eyewitness accounts credible and consistent, noting the witnesses had no prior enmity with the accused and were not shown to have any motive to falsely implicate him.

However, the court found that the incident occurred suddenly, arising from a dispute over passage on a blocked road, without any premeditated motive, and involved a single gunshot. Given these circumstances, the court held that a death sentence was not appropriate and reduced it to life imprisonment. This case illustrates how courts evaluate eyewitness reliability and the significance of premeditation versus sudden provocation in determining the severity of punishment for murder.
