MLD 2020 2039 · Balochistan High Court
This case involved an appeal against the acquittal of two men accused of murdering a woman's husband by shooting him. The complainant (the deceased's wife) claimed to be an eyewitness, but she herself had initially been named as an accused during the investigation, raising serious questions about the reliability of the prosecution's account. No independent witness came forward, making this essentially an unwitnessed crime relying on circumstantial and confessional evidence.
The Balochistan High Court upheld the trial court's acquittal, finding multiple serious flaws in the prosecution's case. The confessional statements recorded under the law were found to be unreliable because proper procedures weren't followed: the accused weren't given adequate time for reflection before confessing, co-accused weren't properly given opportunities to cross-examine each other as required, and the investigating officer improperly handled the accused after their statements were recorded. There was also an unexplained eight-day delay before one confession was recorded. Additionally, the recovery of the murder weapon was questionable—it was allegedly found in a water drain weeks after the crime, with no proof the drain even had running water, and forensic testing was delayed by five months without explanation.
The court emphasized that confessions alone cannot support a conviction without strong corroboration, and that any genuine doubt in the prosecution's case must benefit the accused as a matter of right. This ruling reinforces important safeguards protecting the fairness of criminal confessions and evidence in Pakistani law.
