Abdul Aziz and another V. The State,
MLD 2020 202 · Balochistan High Court
This case involves two men, Abdul Aziz and another appellant, who were caught by Excise Police in Sibi after their car was intercepted based on a tip-off. Police found five kilograms of charas (a narcotic substance) hidden in secret cavities of the vehicle. A trial court convicted them under the Control of Narcotic Substances Act, sentencing each to life imprisonment and a fine.
On appeal, their lawyer argued that the forensic laboratory report used to prove the substance was indeed narcotics was legally defective. The report did not follow the mandatory format required by law, failed to describe the complete testing protocol, and did not explain how the sample was safely transported to the laboratory for testing. The officer who handled the sample was also never questioned in court.
The Balochistan High Court agreed with the defense, relying on Supreme Court precedents establishing that such analyst reports must strictly follow prescribed rules to be considered valid evidence. Since the report in this case failed to meet these legal requirements, the court ruled it had no evidentiary value.
As a result, the High Court overturned the convictions and allowed the appeal, meaning the men were not proven guilty based on the flawed evidence presented.
This case matters because it reinforces that in narcotics cases, technical compliance with forensic testing and reporting procedures is not a mere formality—it is essential to protect the rights of the accused and ensure convictions are based on reliable scientific evidence.
