Amanullah Khan V. The State,

MLD 2020 1926 · Balochistan High Court

The case involved Amanullah Khan, a National Bank of Pakistan officer who worked as a pension-disbursing officer at the bank's city and cantonment branches in Quetta between 1996 and 2005. He was accused under the National Accountability Ordinance of fraudulently misappropriating over 10.8 million rupees meant for pensioners, mainly military pensioners under the Controller of Military Pension Accounts. He allegedly prepared fake pension bills in his own handwriting, forged pensioners' signatures, and withdrew money without proper verification. After the fraud was detected, he repaid about 8.5 million rupees, leaving roughly 2.258 million rupees unaccounted for.

An Accountability Court convicted him in 2010, sentencing him to over four years in prison, a fine equal to the outstanding amount, removal from public office, and a ten-year ban from holding public positions or obtaining bank loans. He appealed to the Balochistan High Court.

The High Court reviewed extensive evidence, including bank records, pension files, and testimony from twenty prosecution witnesses, whose accounts were found to be consistent and unshaken despite lengthy cross-examination. The Court found that Khan, as custodian of pension records, had committed serious forgery and abused his official position for personal gain. Finding no reason to disturb the trial court's findings, the High Court upheld his conviction and sentence, dismissing the appeal.

This case illustrates how courts handle financial corruption by bank officials entrusted with disbursing
