Muhammad Mohid-Din V. Director General, NAB (Balochistan) and another,
MLD 2020 1917 · Balochistan High Court
This case involved a person, Muhammad Mohid-Din, who was not a party to a corruption reference filed by NAB (National Accountability Bureau) in 2014, but who wanted the court to let him appear and record his own statement as a prosecution witness or court witness in that case. He filed an application before the Accountability Court under Sections 265-F and 540 of the Criminal Procedure Code, but the court returned it without deciding it. He then approached the Balochistan High Court through a constitutional petition asking to be allowed to testify and present material he claimed supported the corruption case.
The High Court dismissed the petition. It held that the law under Section 265-F Cr.P.C. allows the complainant or accused to ask the court to summon witnesses acquainted with the facts of the case, but the petitioner was neither the complainant nor otherwise connected to the case. He had never given a statement to the investigating officer and had stayed silent for five years after the reference was filed, without explaining his delay. While courts do have wide discretionary power under Section 540 Cr.P.C. to call any witness whose evidence is essential to a just decision, this power must be used judiciously and not to fill gaps in a case after such a long, unexplained delay. The court noted that if the petitioner had a personal claim against the accused, his proper remedy was to approach a civil court instead. This ruling clarifies limits on outsiders trying to insert themselves into ongoing criminal trials.
