Muhammad Jamshed Khan V. Alamgeer and another,

MLD 2020 1857 · Balochistan High Court

This case was an appeal against an acquittal in a murder case from Balochistan. The complainant alleged that his brother Javed was shot dead by two men, Din Muhammad and Alamgeer, who were hiding near a mosque, during a land dispute. The trial court acquitted Alamgeer (and earlier, other co-accused including Din Muhammad, Lal Muhammad and Sher Muhammad had also been acquitted). The complainant challenged Alamgeer's acquittal before the Balochistan High Court.

The High Court upheld the acquittal. It noted that the complainant himself was not an eyewitness, and the two eyewitnesses who testified had attributed the same role to both Alamgeer and Din Muhammad, who had already been acquitted by the court on the very same evidence. The judges applied the legal principle "falsus in uno, falsus in omnibus" (false in one thing, false in everything), holding that if witnesses were disbelieved regarding one accused, their testimony could not selectively be trusted against another accused facing identical allegations, without independent corroboration. The court also noted that mere absconding by an accused is not enough to prove guilt unless supported by other evidence.

The court reaffirmed that an acquittal carries a double presumption of innocence and can only be overturned if it is clearly perverse or leads to a miscarriage of justice—not simply because another view is possible. The appeal was dismissed, reinforcing protections against inconsistent treatment of co-accused based on the same evidence.
