Abdul Manan and another V. The State,

MLD 2020 1477 · Balochistan High Court

This case involved two men, Abdul Manan and Zain-ud-Din, convicted by a trial court for the murder of the complainant's father, allegedly shot after a dispute. They were sentenced to life imprisonment plus a fine. They appealed to the Balochistan High Court.

The complainant claimed he witnessed the accused catch hold of his father while another fired the fatal shot. However, the High Court found serious problems with this account. It was suspicious that the accused themselves, rather than the complainant who claimed to be present, took the injured man to the hospital. An important eyewitness had been questioned by police on the very first day but was never listed as a prosecution witness, suggesting the police may have hidden testimony unfavorable to their case. Another witness's statement was recorded five days late without explanation. No fingerprint tests were done on the accused or the weapon. There was also no prior enmity between the accused and the deceased to explain a motive for murder.

Given these unexplained gaps and contradictions, the court ruled that the prosecution failed to prove guilt beyond reasonable doubt. It reaffirmed the legal principle that even a single reasonable doubt entitles an accused to acquittal as a matter of right, not leniency. The court overturned the convictions and allowed the appeal.

This case highlights how flawed police investigation and unreliable witness testimony can undermine a criminal case, reinforcing the fundamental principle that doubt must benefit the accused.
