Muhammad Sharif V. The State,
MLD 2020 1390 · Balochistan High Court
This case involved a man named Muhammad Sharif who was stopped by police in Hub, Balochistan, and allegedly found carrying 1800 grams of charas (hashish). He was charged under the Control of Narcotic Substances Act. Although he initially pleaded not guilty and demanded a trial, midway through the proceedings he admitted his guilt and asked for leniency. The trial court recorded this admission under Section 342 of the Criminal Procedure Code and convicted him, sentencing him to two years' rigorous imprisonment plus a fine.
On appeal, the Balochistan High Court examined whether this conviction was proper. The court clarified that admitting guilt during a Section 342 statement is not the same as formally "pleading guilty," so the appeal was legally permissible. More importantly, the court found serious flaws in the prosecution's case: the drugs were sent to the forensic laboratory more than 20 days after being seized, with no explanation for the delay; the police official who transported the sample was never questioned during the investigation; and only one witness was examined at trial. Relying on a Supreme Court precedent, the High Court held that the prosecution had failed to prove the "safe custody" and secure handling of the seized narcotics.
Because these are essential requirements to trust the evidence in narcotics cases, the court set aside the conviction and acquitted Muhammad Sharif, ordering his release. This case highlights how procedural lapses in evidence handling can lead to acquittal, even when a defendant admits guilt.
