Sohail Khan V. The State,

MLD 2020 1340 · Balochistan High Court

This case involved Sodhal Khan, who was convicted by a trial court in Jhal Magsi for illegal possession of a shotgun and twenty live cartridges under the Pakistan Arms Ordinance, 1965, and sentenced to three years' rigorous imprisonment. He appealed to the Balochistan High Court.

According to the prosecution, police (Levies) conducted a raid to arrest suspects wanted in a separate murder case, and during an exchange of gunfire lasting about half an hour to an hour, Sodhal Khan was caught with an unlicensed shotgun and cartridges.

The High Court found major weaknesses in the prosecution's case. It found it implausible that despite prolonged firing, the other wanted suspects managed to escape while only Sodhal Khan was caught, especially since no one on either side was injured. The witnesses also gave inconsistent accounts of how long the firing lasted, and the complainant's version was contradicted by other prosecution witnesses. Crucially, the police never sent the recovered weapon and cartridges to a forensic laboratory to confirm the gun was even functional, and mere recovery of a weapon without such verification was held insufficient to prove guilt.

Relying on precedent that any reasonable doubt must benefit the accused, the court set aside the conviction and acquitted Sodhal Khan. The case highlights how Pakistani courts require solid, corroborated evidence—including forensic testing—before convicting someone of arms possession, and how inconsistencies in prosecution test
