Abdul Khaliq V. Additional District and Sessions Judge-IV and 2 others,
MLD 2020 1118 · Balochistan High Court
This case was about a father, Abdul Khaliq, who filed a petition asking to be made the legal guardian of his minor daughter after his marriage to the child's mother ended. The daughter remained in the mother's custody. The Family Court (Guardian Judge) dismissed his guardianship petition as not maintainable. He then appealed to the Additional District and Sessions Judge, but that appeal was also dismissed on the ground that, under Section 47 of the Guardians and Wards Act 1890, any appeal in guardianship matters should go to the High Court, not the District Judge.
The Balochistan High Court examined how the Guardians and Wards Act 1890 interacts with the Family Courts Act 1964. It held that although guardianship and custody cases must follow the procedure set out in the 1890 Act, such matters fall exclusively within the jurisdiction of Family Courts, which are deemed District Courts for this purpose under Section 25 of the Family Courts Act. Since the original guardianship petition was decided by a Family Court judge who did not hold the rank of District Judge, the correct appellate forum was the District Judge, not the High Court, as specified under Section 14 of the Family Courts Act 1964.
The High Court therefore allowed the petition and directed the appellate court (District Judge) to hear and decide the appeal on its merits, clarifying the correct appeal route in guardianship disputes.
