Noor Muhammad V. The State,
MLD 2020 1071 · Balochistan High Court
This case involved a request to move a criminal trial from one court to another. Noor Muhammad, a sitting minister in the Balochistan Provincial Assembly, was an accused in a murder case registered in 2011, in which he and two others were alleged to have attacked and killed a young man named Abdul Qayum. Muhammad had already obtained pre-arrest bail, which was later confirmed. He then asked the Balochistan High Court to transfer his trial from the Sessions Judge in Loralai to a court in Quetta, arguing that as a provincial minister he had received serious threats of dire consequences from the complainant and feared for his safety.
The High Court rejected the request. It noted that the applicant failed to provide any actual evidence of the alleged threats, such as copies of threatening messages or a report to any authority. Mere claims of danger, without supporting proof, were not enough to justify transferring a case. The court also pointed out that being a minister does not automatically entitle someone to special treatment in court, and that the government, not the courts, is responsible for a minister's personal security.
The judgment reaffirms an important legal principle: cases can only be transferred from a competent court if there are strong, convincing reasons showing that a fair trial isn't possible there - not simply because a party requests it or claims vague apprehensions.
