Janan alias Janak V. The State,
MLD 2020 1040 · Balochistan High Court
This case involved an appeal against a murder conviction. Janan alias Janak was convicted by a trial court for killing Nabiullah, son of the complainant, and was sentenced to life imprisonment plus a fine as compensation under the law. He appealed his conviction, while the complainant filed a separate petition asking the court to enhance the punishment.
The Balochistan High Court examined the evidence, including eyewitness testimony, medical reports, and the police investigation. Two eyewitnesses had seen the attack, correctly described how and when it happened, identified the accused in court, were not relatives of the victim or enemies of the accused, and had given consistent statements to police on the very day of the incident. Their account matched the medical evidence showing the victim died from sharp weapon injuries. The FIR was also filed promptly, naming the accused.
The court noted that the recovered weapon was not useful as evidence since it was never forensically tested, had no blood on it, and wasn't found exclusively with the accused. It also held that even though the motive for the killing was never established, this did not matter because strong direct and medical evidence already proved guilt—motive is not essential when other solid evidence exists.
Given all this, the High Court dismissed the appeal, upholding the conviction and life sentence, and did not increase the punishment either. The case illustrates how Pakistani courts rely on credible eyewitness and medical evidence to sustain murder convictions, even without proof of motive or forensic weapon analysis.
