The State through Regional Director Anti-Narcotic Force Balochistan V. Abdul Wahab and 11 others,
MLD 2019 2048 · Balochistan High Court
This case is about a government appeal challenging a trial court's refusal to let prosecutors reopen an already-completed narcotics trial to introduce new documents. The Anti-Narcotics Force (ANF) had filed cases against several accused persons, and by the time the trial reached its final stage, all prosecution evidence had been presented and the accused had given their statements. At that point, prosecutors tried to recall the investigating officer to submit detailed laboratory analysis reports from the Federal Government Analyst, reports that had been prepared years after charges were framed and were never shown to the accused earlier. The trial court rejected this request, and the state appealed.
The Balochistan High Court upheld the trial court's decision and dismissed the appeal. It explained that while Section 540 of the Criminal Procedure Code allows courts to summon or recall witnesses, this power exists to help the court discover truth, not to let the prosecution fix gaps or weaknesses in its own case after the fact. The court also stressed that accused persons must be given all evidence and documents against them before trial, so they can properly defend themselves; introducing new material at a late stage violates fair trial principles.
This ruling matters because it reinforces that prosecutors cannot use procedural tools to patch up an incomplete case late in proceedings, protecting the fairness and integrity of criminal trials, especially in serious narcotics cases.
