Nasibullah V. The State,
MLD 2019 1962 · Balochistan High Court
This case involved a man named Nasibullah who was convicted by a trial court in Pishin for possessing an unlicensed pistol under the Arms Ordinance, 1965, and sentenced to three years imprisonment plus a fine. He appealed to the Balochistan High Court, arguing that the police failed to follow proper legal procedure when arresting him and recovering the weapon.
The High Court found several serious flaws in the prosecution's case. First, although the investigating officer had recorded a statement from a private witness (someone from the public, not police) at the scene, the prosecution never brought that witness to testify at trial, without any explanation. The court held that failing to produce this witness raised a legal presumption that his testimony would have gone against the prosecution's version of events. Second, the law requires police to involve independent local witnesses when conducting searches and recoveries, and the prosecution did not adequately show why this wasn't done. Third, there was an unexplained 27-day delay before the seized weapon was sent for forensic testing, further undermining confidence in the evidence.
Because of these gaps, the court ruled that the prosecution had failed to prove its case against Nasibullah beyond reasonable doubt. It set aside his conviction and sentence and acquitted him.
This case highlights how procedural safeguards, like producing independent witnesses and avoiding unexplained delays in evidence handling, are essential to ensuring fair trials, especially in cases involving police-led arrests and recoveries.
