MLD 2019 1873 · Balochistan High Court

This case involved an appeal against the acquittal of two men accused of beating a woman and her sisters with sticks in Quetta in 2013. The complainant had filed a case under sections of the Pakistan Penal Code dealing with causing hurt. During the trial, after only four prosecution witnesses had testified, the accused applied for early acquittal under Section 249-A of the Criminal Procedure Code, which allows a magistrate to acquit an accused at any stage if the charge appears groundless or conviction seems improbable. The trial court granted this acquittal, and the complainant appealed.

The Balochistan High Court upheld the acquittal. It found serious problems with the prosecution's case: the FIR was lodged more than ten hours after the alleged incident without any explanation, raising suspicion that the complainant may have deliberated or consulted others before filing it. Even more significantly, evidence showed that some witness statements were recorded by police before the FIR was even registered, suggesting investigation began before the formal complaint was made, which undermines the FIR's credibility. Additionally, the medical evidence contradicted the witnesses' claims of injury, including an alleged fractured finger that medical examination did not confirm.

The court reaffirmed that convictions require solid, credible evidence, and any doubt must benefit the accused. It also noted that acquittals carry a "double presumption of innocence" that appellate courts are reluctant to disturb unless there is a clear miscarriage of justice. Finding none here, the court dismissed the appeal.
