Muhammad Saleem V. Investigation Officer Levies Station Hanna, Quetta,
MLD 2019 1719 · Balochistan High Court
This case arose from a murder FIR lodged by Muhammad Saleem after his brother's body was found in the mountains in Balochistan. After police completed their investigation, a challan (formal charge sheet) was submitted to the trial court, and the accused began facing trial, though one accused remained absconding. The complainant then asked the trial court to transfer the investigation to the Balochistan Crimes Branch, arguing the original investigating officer wasn't making serious efforts to arrest the fugitive accused. The Additional Sessions Judge rejected this request, and the complainant challenged that rejection before the Balochistan High Court.
The High Court upheld the lower court's decision and dismissed the petition. It held that once a challan has been submitted and the court has taken cognizance of the case, the special provisions allowing citizens to seek police accountability (Sections 22-A and 22-B of the Criminal Procedure Code) can no longer be used to interfere with ongoing judicial proceedings. The court noted that the petitioner had not shown any bad faith by the investigating officer or any connection between the officer and the absconding accused. It also observed that the trial court had already issued arrest warrants and initiated proceedings to secure the fugitive's arrest.
This judgment clarifies the limited scope of the "Justice of Peace" powers under the law, confirming they are meant to address police misconduct before trial begins, not to second-guess courts once a case is already under judicial consideration.
