This case concerns a road accident in Quetta involving a Member of the Provincial Assembly. According to the prosecution, the MPA was driving speedily when a Traffic Sub-Inspector signaled him to stop; instead of stopping, his vehicle hit the officer, then struck a car and a cyclist. The officer later died, and others were injured. The accused allegedly fled the scene and evaded arrest for several days before being caught due to public pressure. He was charged not only under ordinary Penal Code offences like murder and rash driving but also under the Anti-Terrorism Act, 1997.
The accused asked the Anti-Terrorism Court to transfer his case to an ordinary criminal court, arguing this was simply a case of rash and negligent driving, not terrorism, and that terrorism charges were added later in bad faith to block a possible compromise between the parties. The trial court rejected this request, and he challenged that decision before the Balochistan High Court.
The High Court dismissed the petition, agreeing that this was not a simple accident case. It noted the accused had no valid license, did not help the injured, had a history of similar serious cases, and that the incident caused widespread media coverage and public fear, particularly among police officers. These factors, the court held, supported treating the act as terrorism. The ruling reinforces that when incidents create public fear and target law enforcement, they can be tried under anti-terrorism laws rather than ordinary courts.
یہ مقدمہ کوئٹہ میں پیش آنے والے ایک ٹریفک حادثے سے متعلق ہے جس میں صوبائی اسمبلی کا ایک رکن ملوث تھا۔ استغاثہ کے مطابق ملزم رکنِ اسمبلی تیز رفتاری سے گاڑی چلا رہا تھا جب ایک ٹریفک سب انسپکٹر نے اسے رکنے کا اشارہ دیا۔ اس نے گاڑی روکنے کے بجائے اسے ٹکر مار دی اور پھر اس کی گاڑی ایک کار اور سائیکل سوار سے بھی جا ٹکرائی۔ بعد ازاں وہ افسر جاں بحق ہو گیا جبکہ دیگر افراد زخمی ہوئے۔ الزام ہے کہ ملزم موقع سے فرار ہو گیا اور کئی دنوں تک گرفتاری سے بچتا رہا، یہاں تک کہ عوامی دباؤ کے نتیجے میں اسے پکڑ لیا گیا۔ اس پر تعزیراتِ پاکستان کے عمومی جرائم، جیسے قتل اور خطرناک انداز میں گاڑی چلانا، کے علاوہ انسدادِ دہشت گردی ایکٹ 1997 کے تحت بھی الزامات عائد کیے گئے۔
ملزم نے انسدادِ دہشت گردی عدالت سے درخواست کی کہ اس کا مقدمہ عام فوجداری عدالت کو منتقل کیا جائے۔ اس کا مؤقف تھا کہ یہ محض ب
