MLD 2018 65 · Balochistan High Court
This case is about a long-running family property dispute in Quetta over land that was to be divided among relatives. An earlier partition suit had already been decided in favour of the plaintiffs, upheld all the way to the Supreme Court, but the decree was never executed within the legal time limit. So the plaintiffs filed a fresh partition suit for the same property.
During this new suit, one of the defendants asked the trial court to add two more people and a housing cooperative as parties, claiming the plaintiffs had sold a related house in Karachi to them, making them necessary parties. The trial court agreed and ordered the plaintiffs to amend their claim to include these new parties. The plaintiffs challenged this order before the Balochistan High Court.
The High Court set aside the trial court's order. It held that a plaintiff is "dominus litis," meaning they have the right to choose whom to sue and cannot be forced to add parties they don't wish to sue, unless those parties are truly "necessary" (essential for an effective decree) or "proper" (useful for complete adjudication). Here, the request to add new parties was not supported by any documents proving the alleged sale, so it was premature and based on mere assertion. The court dismissed the impleadment application, while allowing the other side to reapply later with proper evidence. This case clarifies courts' limited discretion to force additional parties into a lawsuit without solid proof.
