Baz Muhammad and others V. The State and others,
MLD 2018 603 · Balochistan High Court
This case involved a violent clash between two groups over a land or passage dispute, which resulted in the deaths of two men, Dilbar Khan and Faiz Muhammad, and injuries to others. The prosecution alleged that several accused, armed with spades and at least one pistol, attacked the complainant's side after being confronted about laying stones and gravel on a shared passage. Following the incident, the trial court convicted two of the accused, Baz Muhammad and Sultan Muhammad, of murder and rioting, sentencing them to life imprisonment and fines. The convicted men appealed, while the complainant separately sought an even harsher sentence, the death penalty.
The Balochistan High Court examined the evidence presented by six eyewitnesses, including the complainant, and found serious problems. The witnesses gave accounts that contradicted each other and also contradicted their own earlier statements to police. Several witnesses could not convincingly explain why they were present at the scene, and all were closely related to each other, raising concerns about bias. Because of these inconsistencies and unexplained presence, the court could not trust the eyewitness testimony as reliable.
Applying the well-established principle that any reasonable doubt in the prosecution's case must benefit the accused, the court ruled that the prosecution had failed to prove the charges beyond doubt. As a result, it acquitted the appellants, overturning their convictions and sentences, and dismissed the complainant's request to increase the punishment.
