MLD 2018 546 · Balochistan High Court

This case involved a man convicted of murdering his neighbor, Syed Sikandar Shah, in a shooting incident in 2008 in Quetta. The prosecution claimed the accused fired a pistol at the victim while the victim's son, another son, and a nephew watched, and that he then fled on a bicycle. A trial court convicted the accused and sentenced him to life imprisonment, while the complainant separately sought an even harsher sentence.

On appeal, the Balochistan High Court overturned the conviction and acquitted the accused, finding the case riddled with doubt. The eyewitnesses' accounts conflicted with medical evidence: witnesses said two bullets struck the victim, but the doctor found only one wound, and the timeline of events did not match. The eyewitnesses' presence at the scene was itself questionable, since official documents like the medico-legal certificate and inquest report did not mention them being there, and there was no proof they had taken leave from their government jobs that day. The court also found it implausible that three able-bodied men would simply watch a 70-year-old man shoot their relative without intervening. Additionally, the recovery of the alleged murder weapon was flawed because no independent witnesses were involved, violating procedural requirements.

The court reaffirmed the principle that when reasonable doubt exists, the accused is entitled to acquittal as a matter of right, not favor. This case underscores how inconsistencies between eyewitness testimony and medical evidence, plus procedural lapses in evidence collection, can undermine a criminal convi
