Jaffar Khan V. Syed Moead Ahmed,

MLD 2018 355 · Balochistan High Court

This case is about a landlord-tenant dispute in Quetta. The landlord filed a case seeking eviction, claiming he needed the house back for his sister's personal use and that the tenant had stopped paying rent since March 2014, making him a defaulter. The tenant denied these claims. The Rent Controller (trial court) ruled in favor of the landlord and ordered the tenant to vacate, partly because the tenant's lawyer missed several hearings, causing his right to cross-examine the landlord's witnesses and to present his own evidence to be closed one after another. The tenant then appealed to the Balochistan High Court, arguing he was never given a fair chance to defend himself or challenge the landlord's evidence.

The High Court agreed that fairness was compromised. It held that the right to cross-examine witnesses is a valuable constitutional protection (Article 10-A), and that if a party is denied this opportunity, the evidence given against them generally cannot be treated as reliable. Both sides must be tested through cross-examination to determine the truth of their claims. Applying the principle that no one should be condemned without a fair hearing, the court found that the tenant had not received proper opportunity to present his case.

As a result, the High Court partially allowed the appeal and sent the case back to the Rent Controller, directing that both parties be given a full and fair opportunity to produce their evidence before a fresh decision is made. This case highlights the importance of due process and the right to a fair hearing in eviction proceedings.
