Ghulam Farooq V. Dolat Khan,
MLD 2018 1466 · Balochistan High Court
This case involved a landlord, Ghulam Farooq, trying to evict a tenant, Dolat Khan, from a property in Quetta under Balochistan's rent laws. The landlord claimed the premises were rented out verbally for Rs. 2,000 per month, and that the tenant had stopped paying rent since August 2015. The tenant denied being a tenant at all, claiming instead that he had bought the property from the landlord's brother for Rs. 300,000 and held possession as its owner, relying on an agreement signed years after the alleged sale.
The trial court initially dismissed the eviction case, finding no landlord-tenant relationship existed. On appeal, the Balochistan High Court disagreed. It found that the tenant failed to prove his brother-in-law seller actually had any legal authority to sell the property or transfer ownership, since records showed the property remained registered in the landlord's name and mortgaged to a bank by him. The court held that mere claims of a prior purchase, unsupported by proper documentation or authority, could not override the established ownership and tenancy relationship.
The court ruled that ownership itself helps establish the landlord-tenant relationship, and since the tenant could not prove a valid purchase, he must vacate first and pursue any ownership claims separately through proper legal channels. The eviction was allowed, and the tenant was ordered to hand over possession within two months after paying due rent. This case reinforces that tenants cannot resist eviction merely by alleging an unproven sale.
