Muhammad Hanif V. Seraj Ahmed and 2 others,
MLD 2018 1333 · Balochistan High Court
This case involved a property dispute in Panjgur, Balochistan. Muhammad Hanif claimed he had purchased a piece of land 33 years earlier, in 1982, from several individuals through a sale deed. He filed a lawsuit seeking a court declaration of his ownership, an injunction, and cancellation of a separate sale deed through which one respondent had sold part of the land to another respondent. Hanif alleged this second sale was done without his knowledge and led to encroachment on his property. Both the trial court and the appellate court (Majlis-e-Shoora) rejected his suit, so he brought the matter to the Balochistan High Court through a civil revision petition.
The High Court upheld the lower courts' decisions and dismissed the petition. It found that Hanif had failed to properly prove his ownership claim. He did not produce any marginal witnesses to the sale deed (as legally required), did not get the document formally exhibited as evidence, and could not produce any of the original sellers to confirm the transaction. The witnesses he did present had no direct connection to the actual signing of the sale deed, and the document itself was never verified by an Oath Commissioner or Notary Public.
The court concluded there was no error, misreading, or legal irregularity in the earlier rulings. This case highlights how important proper documentary proof and witness testimony are in property disputes in Pakistan—simply claiming ownership isn't enough; the law requires solid, verifiable evidence.
