Soomar Khan V. The State,

MLD 2018 1190 · Balochistan High Court

This case is about Soomar Khan, who was convicted by a trial court in Jhal Magsi for attempted murder (under Section 324 of the Pakistan Penal Code) for allegedly shooting Khalid Hussain with a Kalashnikov. He was sentenced to eight years in prison and ordered to pay compensation. He appealed to the Balochistan High Court.

The High Court found serious problems with the prosecution's evidence. The complainant, the injured victim, and the investigating officer gave conflicting accounts about basic facts, such as when the FIR was filed, who took the injured man to the hospital, and what time officials arrived at the scene. There was also a puzzling inconsistency about how the FIR could have been registered on the date of the incident when the complainant testified she only managed to file her complaint the following day. Additionally, the witnesses admitted there was a pre-existing civil and criminal dispute between the families, raising the possibility that Khan was falsely implicated.

The court held that just because witnesses are not directly related to the parties does not mean they are automatically trustworthy, and courts must carefully scrutinize testimony. Since the prosecution's witnesses contradicted each other on important points and told inconsistent stories, the court ruled that the prosecution failed to prove its case beyond reasonable doubt.

As a result, the High Court allowed the appeal, overturned the conviction and sentence, and acquitted Soomar Khan. This case illustrates how contradictions among prosecution witnesses can create reasonable doubt suf
