Eid Muhammad V. The State,
MLD 2017 992 · Balochistan High Court
This case involved a man convicted of murder under Pakistan's Penal Code after stabbing another man with a knife during an argument, resulting in the victim's death. The trial court had sentenced him to death, and the matter came before the Balochistan High Court both as an appeal by the convicted man and as a reference for confirmation of the death sentence.
The defence argued several points: that required procedures for recording the accused's statement were not properly followed, that the witnesses had not been named in the initial police report, and that they were "chance witnesses" who hadn't justified their presence at the scene.
The High Court rejected these objections. It found that the procedural certificate, though typed rather than handwritten, still satisfied legal requirements and caused no unfairness. It held that witnesses not being named in the FIR did not discredit their testimony, especially since the incident happened in public and people naturally gathered. Their accounts were also consistent with medical evidence about the fatal wound.
However, the court found mitigating circumstances: there was no prior enmity between the men, only a single knife blow was struck following a verbal dispute, and no clear motive was established. Because of these factors, the court upheld the conviction but reduced the sentence from death to life imprisonment, illustrating how courts can lower the harshest punishment even while confirming guilt, based on the specific circumstances of how the crime occurred.
