Pervez Zaki V. The State through National Accountability Bureau, Balochistan, Quetta,

MLD 2017 908 · Balochistan High Court

This case is about a man accused, along with a colleague, of corruption while working at PTCL/WTR Quetta between 1991 and 1999. The National Accountability Bureau (NAB) alleged that funds meant for daily wage staff salaries were embezzled through his connivance with a co-accused who withdrew the money in cash. NAB filed a formal reference against him before the Accountability Court, and he sought pre-arrest bail from the Balochistan High Court.

His lawyer argued that the amount involved was too small to fall under NAB's jurisdiction, since NAB's own Standard Operating Procedure (SOP) restricts it to cases involving more than Rs. 100 million, and that he had already cooperated with the investigation, which was complete.

The High Court agreed. It held that NAB's SOP applies uniformly across the country, and treating this petitioner differently would violate Article 25 of the Constitution, which guarantees equality before the law. The court also noted that NAB was originally meant to tackle large-scale corruption, not petty cases, and that pursuing minor matters diverts resources and overlaps with other agencies like FIA and Anti-Corruption Establishment. Since investigation was complete and evidence already submitted to the court, keeping him in custody served no purpose. The court also emphasized the constitutional right to a speedy and fair trial. Accordingly, his pre-arrest bail was confirmed.

This case matters because it reinforces limits on NAB's jurisdiction and highlights equal treatment and fair trial rights
