MLD 2017 674 · Balochistan High Court
This case involves a dispute over a blocked national identity card. A man had his Computerized National Identity Card (CNIC) issued by NADRA, but it was later blocked. He discovered this when applying for a passport to perform Hajj. He sued NADRA for a declaration and permanent injunction, and the trial court ruled in his favor, ordering his CNIC restored. NADRA did not appeal but instead tried to implement the decree internally. During that process, NADRA's headquarters discovered that the man's CNIC had actually been flagged in a "Fraud Control System" as belonging to an alien, based on information from the Federal Investigation Agency (FIA) and the Ministry of Hajj, linked to a 2007 case where someone else allegedly used his CNIC number to perform Hajj. NADRA then filed an application under Section 12(2) of the Civil Procedure Code, arguing that the original court decree had been obtained through fraud and concealment of these facts. Both the trial court and the appellate (revisional) court rejected NADRA's application. NADRA then approached the Balochistan High Court. The High Court found that the lower courts had focused on technicalities rather than examining the serious fraud allegations on record, and had not given the respondent a proper hearing on these issues. It ruled that the lower courts' decisions were flawed and speculative, set them aside, and sent the case back to the trial court to be decided afresh, with both sides given a fair opportunity to present their case. This shows how courts prioritize substantive justice over procedural shortcuts,
